Denmark Extends Gambling AML Rules to Proliferation Financing and Sanctions

Danish gambling operators face a wider compliance burden from 15 September, with amendments to the country’s anti-money laundering regime bringing proliferation financing, financial sanctions and independent testing more firmly into the controls expected of regulated businesses.

For licensed operators, the change goes beyond another adjustment to conventional AML procedures. Companies must now assess their exposure to proliferation financing and maintain written systems addressing risks involving sanctions against countries, individuals, companies and other entities.

The legislation was adopted by Denmark’s parliament at its third reading on 3 September, leaving less than two weeks between passage and the main commencement date. The law confirms that most of the package takes effect on 15 September 2026.

Gambling AML Checks Move Into New Territory

The gambling provisions sit inside the much broader L 9 legislative package, which amends rules covering financial businesses, payment services, investment firms and several other regulated sectors.

Its AML measures are intended to strengthen Denmark’s implementation of Financial Action Task Force recommendations covering money laundering, terrorist financing and proliferation financing.

For gambling companies, one of the most significant changes is the expansion of their formal risk assessments.

The amended AML Act requires covered businesses to consider risks involving possible breaches, failures to implement or attempts to circumvent legal obligations concerning proliferation financing.

The law also puts a definition of proliferation financing directly into the AML framework. It covers the provision of funds or financial services connected with activities involving nuclear, chemical or biological weapons where those activities are for illegitimate purposes and contrary to national law or international obligations. The activities listed in the legislation range from manufacture and acquisition to development, export, transport, transfer and use.

That makes the change considerably more substantial than adding another box to an existing AML assessment.

Sanctions Become Part of the Written Compliance Framework

Operators must also maintain adequate written policies, procedures and controls addressing financial sanctions against countries, people, groups, legal entities and other bodies.

Their procedures for proliferation-financing obligations must be based on the risk assessment required under the AML Act, although the legislation allows the size of the individual business to be taken into consideration.

This widens the compliance lens.

Traditional gambling AML work has largely concentrated on the origin and movement of funds and the risks of money laundering and terrorist financing. The Danish amendments explicitly bring another question into that process: whether transactions, customers or other relationships could expose an operator to proliferation-financing restrictions or sanctions obligations.

The wording of the legislation is notable here. It does not confine the assessment to direct violations. Businesses must consider potential circumvention and failures to implement the relevant obligations as well.

Independent Testing Adds Another Compliance Requirement

The new framework also reaches into the way operators test their own AML systems.

Policies, procedures and controls covered by the legislation must be tested through an independent audit function. Where a business does not have such a function, the law allows the work to be performed by an external expert.

That requirement gives the changes a practical consequence beyond producing new documentation. Operators need not only to establish the relevant controls but also to have an independent mechanism for examining them.

For businesses without an existing internal audit capability suited to the task, that could mean turning to outside expertise.

A Much Broader Danish AML Package

The gambling measures represent only one section of L 9. The adopted legislation runs across numerous parts of Denmark’s financial and legal framework, including payments, investment businesses and the criminal code.

Among the wider changes, the maximum prison term for certain money-laundering offences rises from 18 months to three years. Particularly aggravated bookkeeping-related offences can carry imprisonment of up to six years.

The legislation also introduces a restriction on cash handled by Danish courts. Courts may not accept cash payments or cash deposits of DKK 15,000 or more. The restriction also captures multiple payments or deposits that are connected, or appear to be connected, rather than allowing the threshold to be avoided simply by splitting a larger amount into smaller transactions.

Other parts of the package deal with financial-sector supervision, payment rules and investment firms, illustrating that the gambling changes form part of a wider attempt to tighten Denmark’s financial-crime and regulatory architecture.

Most Changes Take Effect Today

The timing is unusually immediate for operators following the bill’s passage.

Parliament adopted L 9 on 3 September. Its commencement provision sets 15 September as the general effective date, although two specified amendments do not enter into force until 20 November.

The legislation does not automatically extend to Greenland or the Faroe Islands. Parts of it can subsequently be introduced there through royal decree, with changes made to accommodate local circumstances.

For gambling operators covered by Denmark’s AML regime, however, the expanded obligations are now in effect.

The compliance perimeter has moved beyond the established focus on money laundering and terrorist financing. Proliferation financing and sanctions now have to be incorporated into the risk framework, backed by written controls and subjected to independent scrutiny.
