Acre Transfers Lottery Regulation to State Finance Secretariat

The government of Acre implemented a major reform in the lottery regulation by delegating the task to the State Finance Secretariat (Sefaz). On Wednesday (29), the law was published in the Official Gazette of the state and was officially enacted by Governor Mailza Assis.

The new legislation gives Sefaz more powers in the conduct of lotteries across Acre, which complements the state’s powers in the management of the sector, as the regulation of lotteries continues to grow at the state level in Brazil.

Sefaz Becomes the Sole Lottery Regulatory Authority

Law No. 4,822, which was enacted in December 2022 to organize the Executive Branch of Acre, is amended. This amendment to Law No. 419 of 2022 that creates the organizational structure of the Executive Branch of the State of Acre is inserted. The new system places Sefaz as the only body in the state to regulate, establish rules, authorize and permit lotteries.

The Finance Secretariat will not only have regulatory functions but will also be responsible for licensing, accreditation and inspection of all lottery activities. The agency also has the authority to take administrative action against irregularities or violations detected in the provision of lottery services.

Regulatory Changes Follow Brazil’s Broader Market Evolution

The decision follows that of other Brazilian states that want to have their own systems for lottery games. The national regulatory landscape is constantly changing, and as a result, state governments have increasingly crafted state regulatory regimes that offer more legal certainty and generate additional sources of public revenue.

Acre’s new legislation reflects this nationwide trend, adding to the institutional supervision of lotteries and institutionalizing the powers of the agency that oversees lotteries.

Earlier Legislative Changes Adjusted Monitoring Responsibilities

The approval of Law No. 4,822 comes after legislative discussion that started back in July, when the state government presented a bill for Law No. 419/2022, which was amended. Other such changes affected the monitoring system for lottery-related activities in the state administration.

Sefaz previously had the task of carrying out the financial oversight of lottery operations. In the new administrative scheme, however, monitoring shifted over to the Extraordinary Secretariat for Sports. The sports agency will be tasked solely with monitoring the allocation and use of lottery money, and will “will not directly manage the financial resources.”
