Fenabanca Proposes New Measures to Strengthen the Regularization of the Dominican Lottery Betting Sector
The National Federation of Lottery Betting Shops of the Dominican Republic (Fenabanca) has put forward a set of recommendations to help improve the process of regularizing the lottery betting operations within the country. All the proposals have been forwarded to the government within the scope of the National Regularization Plan for lottery betting shops, sports betting companies, and gaming establishments.

Such an action was triggered by the renewal of the existing Regularization Plan via Executive Decree 197-26, which attempts to revive the process of legalization, as many licensing applications were not addressed during the previous period of time, as deadlines expired in 2022.
Increased Government Control Over Gaming Operations
Moreover, according to the new plan, there will be introduced a new organizational system of overseeing the operations in the gambling industry. According to the decree, the main responsibility of the General Directorate of Internal Taxes (DGII) will be the oversight of tax compliance, as well as assistance with the provisional tax registration of operators.
Also, according to the decree, a reorganization of the structure of the Advisory Council monitoring the implementation of the regularization plan. The council will include officials from the Ministries of Finance and Economy, DGII, the National Lottery, Indotel, Ogtic, as well as representatives of Fenabanca, the Sports Betting Shops Association, the National Horse Racing Commission, and the Casino Association.
Recommendations From Fenabanca
The proposals put forward by Fenabanca will attempt to create better legal grounds for operators attempting to legalize their activities, while minimizing the number of those continuing to operate illegally. First of all, it is recommended to establish the minimum distance of 200 meters between lottery betting shops that will join the Regularization Plan.

As for the shops not being included in the Plan, they should maintain the distance of 400 meters from one another in order to discourage such business. It is also recommended to continue processing the applications submitted earlier according to a transitional regime, thus providing for maintaining the procedures and rights of the applicant.
Moreover, the proposals include such suggestions as exemption of participants of the Regularization Plan from various fees, measures against monopolistic practice and for fair competition, as well as the inclusion of Fenabanca into the Board of the future General Directorate of Games of Chance, which will allow for direct participation in the regulation process of the gambling industry.
Legal Certainty and Fair Competition
As explained by Fenabanca, all the recommendations are aimed at providing for a strong regulatory base for the operators, while at the same time offering sufficient protection. In other words, Fenabanca understands that there is a need for a combination of regulation and legality.
In its press release, Fenabanca has pointed out the reason for making such proposals: “We understand that each of these proposals seeks to strengthen legal certainty, guarantee free enterprise, and preserve the acquired rights of the men and women who make up this sector.”
