ANJL Reviews Industry Contributions to Brazil’s New Sports Betting Authorization Rules

On Friday (31), the National Association of Gaming and Lotteries (ANJL) met to discuss the key elements of the draft ordinance that will replace SPA/MF Ordinance No. 827/2024, which currently sets the rules and criteria for the issuance of authorizations by the Ministry of Finance of Brazil to operate sports betting services.

A significant number of members of ANJL attended this meeting to discuss the work that operators have been doing in advance of the meeting. Discussions focused on proposed amendments, key concerns, and the potential impact that the new regulatory framework could have on licensed betting companies.

Draft Proposal Introduces Stricter Authorization Requirements

The proposed changes are based on three main objectives, according to the Ministry of Finance. First of all, it’s to make the documentation stronger for the prevention of money laundering. The second is to speed up the financial status assessments of operators and the source of capital during the authorisation process.

The proposal also aims to lay the groundwork for more comprehensive and detailed regulations to help minimize information asymmetries between operators and the regulators. The measures aim to establish greater transparency and uniformity in the licensing landscape for regulated gambling in Brazil.

Legal Team Evaluates Technical Contributions

The legal team of ANJL, led by attorneys Hygo Carvalho, Pedro Prates, Rafael Fernandes and Alice Ravazzoli, made a comprehensive study of the technical contributions presented by the association members during the meeting.

Their analysis ranked the proposals according to topic, their impact on the betting operators and their level of criticality. The aim was to narrow down the regulatory issues to the most important ones to be discussed prior to finalizing the collective response of the industry to the government.

Association Plans Joint Submission to the Ministry

The review process will be a key factor in resolving the most sensitive issues found in the draft regulation, and will also be essential to the creation of proposals that will facilitate the proper operation of the regulated betting market in Brazil, said ANJL President Plínio Lemos Jorge.

“We will discuss all of this together within the association. Together, we become stronger. One member’s challenge is everyone’s challenge. We will address issues that matter to the entire sector so that everyone can take part in this process“, Jorge said.

ANJL confirmed that further meetings to finalize the industry’s recommendations would be held over the next few weeks and that they would be submitted to the Secretariat of Prizes and Betting (SPA) as a group. The public consultation on the proposed regulatory changes is open until September 9, 2018, and the Ministry of Finance will consider the feedback received in formulating the bill.
